Seller recommended an unsuitable item: what to save
Before ordering, describe your project and ask the UK seller to confirm which item suits it and why. Save the reply, exact model, limitations and purchase records. If it proves unsuitable, connect the failed use to the advice in a written complaint. Discuss the purpose and sourcing role with Cambridge China Bridge.

Check which purchase and seller you are recording
This guide concerns a personal home or hobby purchase from a UK trader. If you also run a business, record whether this purchase is wholly or mainly outside it. Our consumer-status guide covers that distinction; keep business procurement separate.
Record the legal name of the goods seller alongside the quotation and invoice. A sourcing provider may sell the goods or act as your agent. Use our seller or agent guide to establish the role before treating its advice as advice from your goods seller.
Explain the particular purpose before ordering
Under the Consumer Rights Act, communicating a particular purpose before the contract can make reasonable fitness for that purpose a contract term, even where that use is unusual. The provision does not apply where you did not rely, or could not reasonably rely, on the trader's skill or judgement.
Describe the actual task, materials, existing equipment, operating conditions and result you need. For example: ‘I need a pump for my garden water feature using the attached layout. Please recommend a suitable model and explain any limitations. I am relying on your selection advice.’ Attach labelled photographs or drawings; use our specification guide for measurable requirements.
Preserve the recommendation and its qualifications
Ask the seller to identify the exact model, accessories and configuration it recommends, explain why they suit your stated project, and confirm any exclusions or checks still needed. Resolve a conflict between the advice and the instructions before ordering. If the seller says it cannot assess suitability, preserve that reply too.
Keep the complete email or chat conversation, dated listing, attachments, quotation, accepted terms and order confirmation. After spoken advice, send a dated recap naming the adviser and ask for confirmation. Keep your recap distinct from an acknowledged reply. Record any later change to the project and ask whether the recommendation still applies.
Show the mismatch without changing the evidence
Record delivery details, model and batch identifiers, installation, settings, materials used and what happened during use. Photograph the item and setup, retain instructions and packaging, and preserve original files. Explain how the actual conditions compare with those disclosed before ordering, including any differences.
An item can operate yet still fail your stated task. Show the practical mismatch, such as a recommended pump failing to circulate water through the disclosed layout. Stop unsafe testing and avoid alterations while the complaint is assessed. Consult our repair-before-resolution guide before commissioning work.
Send a purpose-based complaint to the seller
Write: ‘Before ordering, I explained the following purpose: [purpose]. You recommended [model] in [message]. I relied on that advice. Under the disclosed conditions, the item [result], so it cannot perform the stated task. Attached are the recommendation, purchase record and evidence. I request [remedy]. Please explain your proposed resolution and inspection arrangements.’
For a qualifying consumer breach of the fitness-for-purpose term, statutory remedies include short-term rejection, repair or replacement, and price reduction or final rejection, subject to their conditions. They are not freely interchangeable. Act promptly and use our goods complaint guide for the wider claims process.

If the seller disputes suitability
Ask which fact it disputes: what purpose you disclosed, whether it recommended the model, your reliance, the supplied configuration or the conditions of use. Request a written explanation and supporting technical findings. Keep the complaint correspondence and inspection handover record with the original advice.
If technical evidence is needed, ask an independent specialist to compare the item with the disclosed task and document the setup and findings. Agree the scope and cost before commissioning work. If unresolved, give an adviser the complete chronology and ask about the appropriate remedy and deadline for your circumstances.
Frequently asked questions
Does the seller's recommendation have to be written?
The purpose can be communicated expressly or by implication; writing helps preserve what happened. After spoken advice, email a recap and ask the seller to confirm it.
Can I complain if the item works but is unsuitable?
Potentially. Reasonable fitness for a disclosed particular purpose can be a contract term, subject to the reliance conditions. Show how it fails that task under the conditions you described.
What if I chose the model myself?
Preserve the actual exchange. Choosing a model does not explain whether you relied on suitability advice. Record what you asked, what the seller confirmed and any warning it gave.
What should I attach to a fitness-for-purpose complaint?
Attach your pre-order purpose statement, the seller's recommendation, exact model and configuration, purchase record, instructions, and evidence showing the mismatch under the disclosed conditions.
