How to recover overcharged import VAT

A VAT-registered UK importer recovers overpaid import VAT by reducing output tax due in Box 1 of its VAT return and keeping supporting records. The excess is not recoverable as input tax, and HMRC says registered businesses cannot claim it through C285 or the online repayment services. Cambridge China Bridge can help gather shipment paperwork.

Separate an overcharge from ordinary VAT recovery

Ordinary recovery concerns import VAT correctly due on eligible business imports. An overcharge concerns the excess above what was due. HMRC says that excess cannot be recovered as input tax because it was not due to HMRC. Our import VAT guide covers ordinary recovery and its evidence.

Before calling an amount an overcharge, ask your customs agent to compare the declaration with the invoice, freight costs and tax calculation. A bill larger than expected is a reason to investigate, rather than proof that HMRC received too much. For helmet purchases, see our guide to VAT on bicycle and motorcycle helmets. For tax shown on transport invoices, see our guide to VAT on freight and handling.

Use the Box 1 adjustment

HMRC’s repayment guidance tells VAT-registered importers to reduce output tax due in Box 1 of their VAT return and keep records supporting the claim. It expressly excludes C285 and the online repayment services for their overpaid import VAT.

Give your accountant the calculation of the excess and the supporting documents before filing. Ask them to reconcile any import VAT already recovered, so the same excess does not enter the return again through ordinary input-tax recovery.

Build a record that explains the excess

HMRC requires supporting records. For a practical file, retain the original declaration and its reference, commercial invoice, freight and insurance evidence, evidence of VAT paid, relevant import VAT certificate or postponed accounting statement, and correspondence explaining the error.

Add a calculation showing the original amount, the correct amount and the difference. Identify the disputed value, classification or other entry, explain why it is wrong, and cross-reference the evidence. Keep the filed return and adjustment working paper together. Use our declaration checking guide to organise the agent’s review.

Keep duty and postponed accounting distinct

HMRC says VAT and import duty may need separate claims. Ask the agent to separate any duty overpayment from the VAT excess and confirm the declaration correction needed. Our import duty and VAT guide explains the underlying charges.

If the VAT was accounted for through postponed VAT accounting, check HMRC’s separate error guidance before applying a standalone reduction. It directs nil net tax errors to the next return, with equal adjustments in Box 1 and Box 4; otherwise, follow the error correction procedures. Ask your accountant to check the original return and statement together. For statement fields, see our guide to reading a postponed import VAT statement.

Agree who will finish the correction

Ask the customs agent for a written explanation and corrected calculation. Ask the accountant to confirm the VAT treatment and record the adjustment against the shipment. Track any declaration amendment and duty claim separately, alongside the VAT return working paper.

Cambridge China Bridge can help gather factory invoices and shipment documents through its staff in China. Give the agent and accountant a consistent document pack, and ask the supplier to explain any mismatch in the invoice or shipping paperwork.

Frequently asked questions

Can I use C285 if I am VAT registered?

HMRC says VAT-registered businesses cannot use C285 or the online repayment services for overpaid import VAT. Recover the excess through the VAT return adjustment.

Which VAT return box recovers overcharged import VAT?

HMRC’s repayment guidance says to reduce output tax due in Box 1 and keep supporting records. Check postponed accounting errors against its separate guidance.

Can I reclaim the excess as input VAT?

No. HMRC says overpaid import VAT cannot be recovered as input tax because it was not due to HMRC. Separate the excess from VAT correctly due.

What records should I keep for an import VAT overcharge?

Keep the declaration, invoice, payment evidence, relevant VAT certificate or statement, agent correspondence and a calculation explaining the excess. Retain the return adjustment working paper with them.
