VAT on returns resold from a UK warehouse
A return retained in a UK warehouse is UK-located stock when resold. Assess that sale separately from the original overseas dispatch and refund. VAT responsibility depends on seller establishment, the resale channel and the customer's VAT status. Cambridge China Bridge can help organise the stock and supplier records.

Record the location for the new sale
HMRC's sales guidance uses the goods' location at the point of sale. If a customer returns an overseas-dispatched item to your UK warehouse and it stays there for resale, assess the resale as UK-held stock. Do not carry over the original overseas-dispatch treatment.
Record the warehouse address, stock owner, selling entity and intended customer destination before relisting. This guide focuses on resale within Great Britain. Ask for a separate assessment where Northern Ireland is involved. For condition checks before relisting, see testing and resale of customer returns.
Separate the refund from the resale
HMRC says to adjust your VAT return if you originally charged VAT and refunded it to the customer. If you did not originally charge VAT, that return does not require an amendment on this basis.
Keep the original order, refund confirmation, warehouse receipt and new sale linked in your records. If the original sale used a marketplace, obtain its refund and VAT statement before making your own adjustment. Review original import paperwork separately using who is the importer of record.
Check the seller's establishment
Stock location and seller establishment are separate checks. HMRC defines an overseas seller as one without a UK establishment. A UK fixed establishment requires a permanent physical presence with human and technical resources to make or receive taxable sales.
Do not assume a warehouse address settles that question. Ask your VAT adviser to assess the actual operating arrangements and give the marketplace consistent information about the selling entity.
Identify who handles VAT on resale
For an overseas seller making direct sales of taxable UK-held goods, HMRC requires VAT registration, charging and accounting regardless of value. Through a qualifying online marketplace, the marketplace generally accounts for VAT on UK-held goods sold by an overseas seller. For sales to UK VAT-registered businesses, the seller instead accounts for any VAT due; obtain the customer's VAT details.
Where the seller is UK-established, HMRC places VAT liability with that seller rather than the marketplace. Check registration requirements and the applicable product treatment with your adviser. Do not treat every website service as a marketplace: HMRC's definition requires involvement in sale terms, payments and ordering or delivery.

Approve the warehouse resale instructions
Before releasing the return for sale, ask your accountant and channel operator to confirm the selling entity, establishment assessment, warehouse location, customer VAT status and who will account for VAT. Give the warehouse matching instructions for the listing, dispatch record and sales paperwork.
Cambridge China Bridge has its own staff in China and can help connect factory and batch records with the returned stock. If you later plan to sell into the EU, EU buyers follow EU rules; use the separate guide to selling China-made goods into the EU.
Frequently asked questions
Does a returned item keep its original import VAT treatment?
Assess the resale using the goods' location when sold again. A return retained in a UK warehouse is UK-held stock; deal with the original refund separately.
Does a UK returns warehouse make us UK-established?
Do not assume so. HMRC's fixed-establishment test requires a permanent physical presence with human and technical resources to make or receive taxable sales.
Who pays VAT when an overseas seller resells through a marketplace?
For UK-held goods, the marketplace generally accounts for VAT. If the customer is a UK VAT-registered business, the seller accounts for any VAT due. Confirm the customer's VAT details.
Can an overseas seller resell the return through its own website?
For direct sales of taxable goods already in the UK, the overseas seller must register, charge and account for VAT regardless of value. Agree the treatment before relisting.
