Can Section 75 cover additional losses?

Yes, an eligible Section 75 claim can include losses beyond the purchase price where you have a corresponding claim against the supplier. Explain the breach, connect each extra cost to it and provide evidence of the loss and steps taken to limit it. Discuss supplier records with Cambridge China Bridge.

Establish eligibility before adding losses

Section 75 gives an eligible borrower a like claim against the creditor for the supplier’s breach of contract or misrepresentation. Additional losses therefore depend on what you could claim against the supplier. They are not automatically covered simply because the purchase qualifies.

For cash-price limits, card deposits and payment routes, use our Section 75 eligibility guide. If buying stock or equipment for your business, ask the issuer to assess your actual credit agreement and transaction before preparing an extensive loss claim.

Connect each loss to the broken promise

For consumer breach-of-contract damages, the loss must have been caused by the breach and be sufficiently foreseeable. Loss you could reasonably have limited or avoided is not recoverable. A receipt proves expenditure, but does not by itself establish that connection.

Write a chronology linking the agreed specification or delivery promise, what went wrong and the resulting expense. For an urgent replacement, retain comparable quotes and explain the urgency. Preserve messages showing any particular purpose or deadline communicated before ordering. Identify unrelated causes, such as your own change of specification, rather than attributing every later expense to the supplier.

Build a cost schedule with supporting records

Separate the purchase-price claim from each proposed additional loss. For every entry, record the reason, date, payee, currency, amount and supporting file. Distinguish paid invoices from estimates. For replacement goods, explain the extra cost compared with the original arrangement, rather than simply adding the entire replacement invoice.

Possible entries to ask the issuer to assess include diagnostic reports, necessary return transport, repairs or damage caused by faulty goods. Keep photographs, reports, invoices and payment records together. These are candidates for assessment, not promises of recovery. Our supplier quality-cost guide helps organise the underlying records.

Record how you limited the loss

Keep the supplier’s proposed remedy and explain why you accepted or rejected it. Record alternatives considered, comparable quotations and why further spending was necessary. Before commissioning costly work, ask the issuer what evidence it wants and preserve the goods’ condition through photographs or an independent report.

Show refunds, credits and other recoveries alongside the costs they relate to. Ask the issuer to assess the remaining loss. If money arrives during an open dispute, follow our supplier refund during a chargeback guide and update the case records.

Ask for the correct assessment

A chargeback seeks reversal of a card transaction and recovery is limited to that card payment. An eligible Section 75 claim can include damages beyond it where the corresponding supplier claim supports them. Ask the issuer to identify which route it is assessing and to address your additional-loss schedule explicitly.

Send a covering explanation, chronology, cost schedule and indexed supporting records. Request written reasons for any rejected entry and ask promptly about applicable deadlines. Use our delayed-order chargeback guide for that route. Cambridge China Bridge’s staff in China can help request supplier correspondence, inspection records and explanations of proposed remedies.

Frequently asked questions

Can Section 75 pay more than the purchase price?

Potentially, if the purchase qualifies and you have a corresponding claim against the supplier for additional losses. Explain each loss and provide supporting evidence.

Can I include return shipping or repair costs?

Ask the issuer to assess them separately. Provide invoices, payment records and an explanation of why the breach made the expense necessary. A receipt alone does not establish recoverability.

What evidence links extra costs to the supplier?

Provide the agreed promise, evidence of the breach, a chronology and records explaining each resulting expense. Keep comparable quotes and evidence of steps taken to limit the loss.

Can a chargeback recover my additional losses?

Chargeback recovery is limited to the card payment. Ask for a separate Section 75 assessment of additional losses where eligible, and disclose refunds or credits already received.
