Getting started

Are China retro console games legal in the UK?

Bundled games need copyright permission or an applicable exception; buying the console does not establish either. Check each game's source and licence separately from the emulator. If permission is unclear, request hardware with verified software and no bundled games. Supplier checks can be coordinated by Cambridge China Bridge.

Separate the emulator from the game files

An emulator is software that reproduces another system's behaviour so compatible games can run. Game files, often called ROMs or disc images, contain the games themselves. Ask for separate inventories of the emulator, game files and any original console boot software. Check internal storage, supplied memory cards and download instructions.

Check permission for each component separately. An emulator's licence does not establish permission for somebody else's games or boot software. Ask for its exact name, version, source and licence terms rather than accepting an open-source label. For branded casing, logos and packaging, use our counterfeit goods guide.

Check the actual games and intended use

UK guidance requires permission to use copyright material unless an applicable exception covers the use. Request a title-by-title catalogue, the rights holder, the file source and evidence authorising the supplier's bundle. Contact the rights holder or its authorised licensing representative through independently found details. Ask them to confirm the supplier and the exact catalogue.

Licences can be limited by purpose, time and territory. Ask whether the arrangement covers UK use, factory preloading, bundled resale and your proposed business use, including customer play at your premises. Keep the confirmed catalogue and licence together. Paying the seller and seeing a working demonstration are purchasing evidence, not rights-holder confirmation. Our TV box guide covers streaming access separately.

Treat backup and abandoned-game claims carefully

UK legislation permits a lawful user of a computer program to make a backup copy necessary for their lawful use. This is a conditional exception, not blanket permission for a supplier's game library. Do not assume that owning an original cartridge authorises a downloaded copy from another source. Ask a UK intellectual property solicitor before relying on the exception for your proposed copying.

Treat descriptions such as abandoned, no longer sold, free or for personal use as claims needing evidence. Ask the supplier to identify the permission or precise exception it relies on. For independently developed games, request the creator's release terms and check that they cover your intended use. Pause approval if the explanation cannot be verified.

Specify a console without unverified content

Request a hardware-only offer or a console containing only software whose permissions you have checked. State that no unapproved game files, original console boot files, game-filled memory cards or links to unverified libraries may be supplied. Ask whether the proposed configuration still operates without those files. Alternatively, request a bundle whose named games and permissions the rights holder confirms.

Put the approved software inventory, sources, licence documents and prohibition on substitutions into your product specification. Have a competent technician compare the sample and shipment units with that inventory, including recovery files and automatic downloads. Use authorised content for functional testing. A successful test demonstrates operation; it does not establish copyright permission.

If you already have the console

Pause use of doubtful games and pause shipment or resale of affected stock. Preserve the advert, invoice, messages, catalogue and photographs before changing the device. Ask the seller for verifiable authorisation or a proposal for return, replacement or a configuration without the disputed content. Seek advice before altering files if a dispute is underway.

Have a competent technician check internal storage, removable media and recovery features before removing unverified content. Verify the remaining software and obtain games from sources with terms covering your use. Cambridge China Bridge's own staff in China can coordinate supplier enquiries and checks against the agreed inventory; rights-holder confirmation and legal advice remain separate.

Frequently asked questions

Does buying a retro console make its games legal?

The purchase does not establish copyright permission. Verify the bundled titles, their source and the licence covering your use, or identify an applicable exception.

Does an open-source emulator include game rights?

Its licence does not establish permission for somebody else's games or original console boot software. Check each component's source and terms separately.

Can I download a game if I own the cartridge?

Do not assume ownership authorises another source's download. The computer-program backup exception concerns a lawful user making a copy necessary for lawful use. Seek advice on your particular copying.

Can I buy a retro console without bundled games?

Ask for hardware only or verified software without games. Specify empty game storage, no game-filled cards or unverified download links, and check recovery features before shipment.
