When your forwarder outsources UK customs clearance

Agree the filing company's identity, whose name it declares in, the representation type, instruction routing, broker changes and access to records. Put service promises alongside written customs authority, with each party's role clear. Supplier paperwork can be coordinated by Cambridge China Bridge.

Identify the company actually filing

Ask your forwarder for the filing company's legal name, address and operational contact before sending clearance instructions. Ask whose name the declaration will be made in, who will appear as declarant and representative, and whether any further subcontractor is involved. A forwarder's invoice alone does not answer those questions.

Record the importer, filing company and forwarder's roles separately. Ask for those details to be confirmed against the completed declaration. Our guide to sourcing agents, forwarders and customs brokers explains the broader division of work.

Separate service promises from customs authority

HMRC requires written confirmation of the representation terms, with a copy kept for your records. Whoever acts on your behalf needs your written instructions showing direct or indirect representation. Ask the forwarder to explain how that authority reaches and covers the actual filing company; avoid assuming a freight booking settles this.

Separately agree who answers queries, checks the draft, arranges corrections and handles complaints or disputed charges. Describe these as service commitments. Do not treat a promise to handle clearance as the answer to whose name is used or which representation applies. Use our written customs authorisation guide for the authority document.

Make the instruction route traceable

Choose a named buyer contact authorised to approve clearance instructions. Agree whether instructions go through the forwarder or directly to the broker, who acknowledges receipt and who resolves conflicting messages. Ask for confirmation that the filing company received the approved version, including attachments.

Specify which decisions must come back to you: proposed changes to classification, value, origin, procedure or VAT treatment. Ask for a pause while unresolved questions are answered, and agree an escalation contact when goods are moving. Keep revised instructions with the versions they replace so an old email cannot silently become the filing basis.

Agree how subcontractor changes are handled

Ask for prior notice and your written approval before a different company files. The notice should identify the replacement, explain the reason and confirm the representation type, instruction route and record access. Present this as a term you want agreed, rather than an HMRC approval process.

Agree what happens if the usual broker is unavailable: who contacts you, whether filing waits and how the replacement receives the current documents. Ask for the written authority to be reviewed before the replacement acts. Avoid accepting a substitution that leaves you unable to identify who submitted the declaration.

Secure records beyond the forwarder's portal

Agree delivery of the completed declaration, its reference, supporting documents, approved instructions, queries and amendment history. Specify the delivery trigger, format, contact and any retrieval charges. Include access after you stop using the forwarder or it changes brokers. Download copies into your own shipment file rather than relying entirely on portal access.

HMRC says appointing someone does not remove your responsibility for customs due diligence. Review what was filed against what you approved, and ask the named contact to investigate discrepancies. Our guide to obtaining and auditing your customs declaration covers that review.

Frequently asked questions

Who actually files my customs declaration?

Ask for the filing company's legal name and contact, then ask whose name it declares in and who appears as declarant and representative. Check the completed declaration against that explanation.

Should I send instructions to the forwarder or broker?

Agree a named route and approval contact. If the forwarder passes instructions on, ask for acknowledgement that the filing company received the approved version and attachments.

Can my forwarder change customs brokers?

Ask for prior notice and written approval as a service term. Before a replacement files, confirm its identity, representation, authority, instructions and how you will receive records.

What records should I ask my forwarder for?

Request the completed declaration and reference, supporting papers, approved instructions, queries and amendment history. Agree how copies reach you and how access continues after the service ends.
