Can I cancel a winning online auction purchase?

Possibly, if you bought as a consumer from a trader through an online-only auction and UK cancellation rules apply. Public auctions with an in-person attendance option are excluded from that cancellation right. Business purchases need a contract check. Discuss sourcing arrangements with Cambridge China Bridge.

Check your buying purpose and the actual seller

UK consumer cancellation rules concern purchases from traders by consumers. Buying stock or equipment for your business does not give you that consumer cooling-off right. A genuinely private seller also falls outside those trader-to-consumer rules. Record your purchasing purpose and ask who actually sold the lot.

Save the seller profile, lot listing, invoice and auction terms. Identify whether the auction house sells the goods or acts for another seller, using our seller or agent guide. Check the seller's trading activity as well as its account label. Shipment from China alone is insufficient to decide which rules apply; seek advice if the overseas contract position is unclear.

Distinguish online-only bidding from a public auction

An online-only auction does not qualify for the public-auction cancellation exception merely because bidders compete. The UK definition requires consumers to attend or have the possibility of attending in person. Conversely, bidding remotely at a qualifying public auction does not remove that exception simply because you used a website.

Ask whether you could attend the auction itself in person, and retain the advertised venue and attendance arrangements. Distinguish attendance at the sale from a viewing appointment or collection visit. If the seller relies on the public-auction exception, ask it to explain how the actual sale met the definition.

Check cancellation eligibility before arranging a return

For an online-only trader-to-consumer sale covered by UK distance-selling rules, winning the bidding does not itself remove cancellation rights. Product exceptions still need checking. Use our cancellation-exceptions guide rather than assuming every auction lot is returnable.

For an eligible personal purchase, ask Trading Standards or a UK consumer adviser to confirm whether cancellation can be notified before delivery. Our personal China order guide explains deadlines and return arrangements. Record the order and delivery dates, send the notice promptly and ask for the return address before booking freight back to China.

Separate the buyer's premium from the goods price

Request an itemised statement separating the winning bid, buyer's premium, VAT, delivery and any other charges. For the premium, ask who receives it, what it pays for, and whether it forms part of the goods price or relates to a separate service contract. Request the terms supplied when you registered and bid.

Do not assume that cancelling the goods settles every service charge. For a separate service covered by consumer cancellation rules, ask Trading Standards or a UK consumer adviser whether an expressly requested early start and the information supplied permit a proportionate charge for work supplied. Ask whether full performance removes the cancellation right and what request and acknowledgement were required. Check the service records using the personal-order guide.

Send a clear notice or request an agreed release

Where an applicable cancellation right exists, write: “I am cancelling my purchase of [lot], order reference [reference]. Please confirm receipt, return arrangements and an itemised refund calculation, including the treatment of the buyer's premium.” Send it to the seller and copy the auction house. Keep proof of sending and request a hold on dispatch where possible.

For a business purchase or a sale without that cancellation right, request written agreement to release you and explain any proposed charges. Our business-order cancellation guide covers settlement evidence. If goods are damaged or misdescribed, raise that separately with photographs and the listing; obtain advice before settling a disputed complaint involving second-hand public-auction goods.

Frequently asked questions

Can I cancel after winning an online auction?

Potentially, for an eligible consumer purchase from a trader under UK distance-selling rules. Online-only bidding does not itself exclude cancellation. Check the seller, auction format and product exceptions.

Does bidding online at a public auction give cancellation rights?

A qualifying public auction is excluded from the consumer cooling-off right even when you bid remotely. Check whether you had the option to attend the auction in person.

Will my buyer's premium be refunded if I cancel?

Ask who charged it and whether it belongs to the goods price or a separate service contract. Request an itemised refund calculation and the basis for any retained service charge.

Can my business cancel an auction purchase shipped from China?

Business purchases do not carry the consumer cooling-off right. Check the auction contract and request an agreed release. Ask for written confirmation of charges, refunds and whether dispatch has stopped.
