Whole ancho duty and ground-chilli suspensions

Read from the UK Trade Tariff on 2 October 2026, heading 0904 covers pepper and dried, crushed or ground Capsicum and Pimenta fruit. Whole dried ancho chillies fall within the dried-chilli family; flakes and powder require the crushed-or-ground classification. The sweet-pepper rows provide classification comparisons, rather than alternative descriptions to choose for the same goods.

For goods from China, 0904 21 90 20 carries 0% duty. Line 0904 22 00 19 has a 4% base duty and a 0% autonomous suspension that excludes mixtures and preparations. The sweet-pepper comparison lines carry base rates of 8% whole and 4% ground, with 0% suspensions recorded. The supplied facts show no anti-dumping or countervailing duty on these lines.

The tariff attaches organic import control. Confirm with your approved UK organic control body whether an inspection certificate is needed for release as organic; the exporter’s control body issues it. Confirm the arrangements for Chinese goods with your customs broker before shipment. Confirm the commodity code using the variety, ingredients and physical form. See the pepper and dried chillies guide for the wider heading.

Specify the ancho variety, pod condition and flavour

Ask the processor to identify the chilli variety and growing origin, and supply whole-pod photographs alongside a representative sample. Agree whether the order is whole pods, deseeded pieces, flakes or powder. Record the accepted colour, aroma, flavour and pungency against the approved sample, rather than accepting a generic description of mild dried chilli.

Set written acceptance criteria for moisture, broken pods, stalks, seeds, foreign matter and insect damage. Agree the drying and microbial treatment, whether irradiation is used, and packaging that keeps the product dry. For powder, specify grind consistency and whether seeds are included. Agree batch testing for aflatoxins, ochratoxin, pesticide residues, illegal dyes and Salmonella.

Worked duty example

Illustrative example, not a quote: Illustrative order: 5 tonnes of whole dried ancho chillies under 0904 21 90 20, invoiced at £15,000 free on board, with £1,500 of freight and insurance to the UK. The customs value is £16,500. Duty at 0% is £0. Import VAT at 20% is charged on the customs value plus duty, £16,500, so it is £3,300. With no duty, the only import tax is the VAT, which a VAT-registered importer can usually reclaim. The import duty and VAT guide explains each step. This assumes the goods are standard-rated for VAT. Most food for human consumption is zero-rated, and animal feed can be too, in which case no import VAT is due, so check the rate for your product in HMRC's VAT Notice 701/14.

Inspection checklist

Identity: compare pods and a prepared sample with the approved ancho sample; investigate different shapes, colours or flavour before accepting the lot.

Condition: inspect for mould, dampness, insect damage, stones and excess stalks; check moisture and broken material against the specification.

Batch evidence: match laboratory reports to the shipment lot and check results against applicable contaminant and pesticide limits; keep a sealed reference sample.

Packing and labels: check dry, intact liners, batch identification and retail labelling, including the product name, net quantity and UK business address. If the spices are irradiated, confirm the applicable labelling requirements with the relevant food authority before approving the artwork.

What goes wrong

A generic chilli can pass a colour check while giving the wrong flavour or heat in the buyer’s recipe. Ground product also makes substitution and excess seed or stalk material harder to spot. Approve whole-pod identity and a preparation made from the sample before agreeing powder specifications.

Damp storage can lead to mould and contamination problems, while a clean-looking lot can still fail laboratory checks. Check the current high-risk food list for the product and Chinese origin before booking; ask your customs broker or the relevant food authority to confirm any pre-notification and border-check requirements. Arrange testing and certification around the actual batch rather than relying on an unrelated supplier report.
