How to set aside a default CCJ for a China order

Request the claim records from the court, check how and where the papers were served, and seek legal advice promptly about a set-aside application. Explain both why you missed the claim and why you dispute the debt. Supplier records can be coordinated by Cambridge China Bridge.

Obtain the court file and record when you found out

For a disputed personal China order involving a default County Court judgment in England and Wales, contact the court using independently checked contact details. Give the claim reference and ask for the claim form, particulars of claim, judgment, recorded service details and any available certificate of service or service order. Confirm the claimant’s identity, the defendant named and the address used.

Record when and how you discovered the judgment, then keep a dated log of your actions. Preserve the letter, credit report entry or enforcement notice that alerted you. If you have received a claim but no judgment, use our court claim response guide.

Check service against your address history

Compare the recorded address, service method and dates with where you lived and the contact details you supplied. Give your adviser moving records, address-change messages, returned envelopes and evidence of when the seller knew your new address. Ask them to check the claim form and particulars separately, including any order authorising alternative service.

Where the usual or last known address rules apply, a claimant who has reason to believe you no longer live there must take reasonable steps to find your current address. Those rules also permit last known address service in specified circumstances. An old address therefore needs investigation; do not assume it proves invalid service.

Seek prompt advice about the set-aside grounds

Ask a solicitor or Citizens Advice for help promptly, taking the court records and your discovery timeline. Court staff cannot give legal advice. Ask your adviser whether the judgment was wrongly entered under the default judgment conditions, requiring the court to set it aside, or whether you need a discretionary set-aside.

For a discretionary set-aside, the court may act where you have a real prospect of successfully defending the claim or there is another good reason to set aside or vary the judgment, or allow a defence. The court must consider whether you applied promptly. Explain any delay and avoid waiting for supplier negotiations to finish.

Prepare evidence about the disputed order

Prepare a concise account linking each disputed charge to evidence. Identify who took the order, what was agreed, what you paid, what arrived and what cancellation or complaint messages were exchanged. Explain that this was a personal purchase and give your adviser the actual order terms. Separate confirmed facts from assumptions.

Keep original invoices, payment records, photographs and complete message threads. Preserve Chinese originals alongside translations and identify who prepared each translation. Our Chinese court evidence guide covers these records. Ask your adviser to prepare or review a draft defence addressing the claim itself.

Apply to the court and check enforcement separately

The application route uses the application notice, N244, sent to the court. State the order requested and why, and supply supporting evidence. The official guidance requires a completed statement of truth, signature and current contact details. Check the applicable fee and whether help with fees is available. Most applications require a hearing, which you are expected to attend.

If enforcement is threatened or underway, show the notice to your adviser urgently and ask whether to request its suspension alongside the set-aside. The application notice can also be used to ask for suspension of enforcement. Obtain confirmation of any court order affecting enforcement. Our disputed debt collector guide helps organise correspondence.

Frequently asked questions

Can I challenge a CCJ if I never received the claim?

You can ask the court to set it aside. Obtain the service records and seek advice on the grounds; explain why you missed the claim and why you dispute the debt.

Does sending the claim to my old address make it invalid?

Not necessarily. Last known address service is permitted in specified circumstances. Give your adviser your address history and evidence of what the claimant knew.

How quickly should I apply to set aside a default judgment?

Seek advice and act promptly. For a discretionary set-aside, the court must consider whether you applied promptly. Record when you discovered the judgment and explain any delay.

What should I do if enforcement has already started?

Show the enforcement notice to your adviser urgently. Ask whether to request suspension of enforcement alongside the set-aside, and obtain confirmation of any relevant court order.
