Can I replenish my Northern Ireland duty waiver?

Yes, you may reclaim state aid used to waive duty through the Duty Reimbursement Scheme if you can prove a qualifying outcome for the goods. HMRC amends your state-aid balance after approval. Claim as soon as supporting evidence is available. Cambridge China Bridge can help organise factory and shipment records.

What a replenishment claim restores

A replenishment claim reclaims state aid used through the Customs Duty Waiver Scheme. HMRC distinguishes this from repayment of duty already paid and remission of deferred duty. For an approved replenishment claim, HMRC amends your state-aid balance.

Check the original route before calculating the claim. For movements from Great Britain to Northern Ireland, HMRC allows the full amount. For direct imports from China, where EU duty exceeded UK duty at import, the claim covers the difference between the applicable rates. For route planning, see importing directly into Northern Ireland.

Prove a qualifying outcome

Showing that goods stayed somewhere in the UK is not enough by itself. HMRC requires evidence of a qualifying condition, with no prior movement into the EU. These conditions include physical retail sale or intended physical retail sale in Northern Ireland, onward movement to Great Britain, final consumption, permanent installation or destruction in Northern Ireland. Export outside the UK and EU is also a qualifying condition.

For sales through another Northern Ireland business, HMRC asks for evidence of the sale and evidence that the goods will subsequently be sold in Northern Ireland. Ask your customer for destination and onward-sale records before relying on its address alone. For GB stock sales, see our guide to VAT on sales to Northern Ireland.

Build evidence around the goods

For goods moved to Great Britain, the claim must include transport documentation, such as a road consignment note or freight invoice. HMRC also asks for enough information to connect the goods moved with those originally charged duty on entry to Northern Ireland. For final consumption or permanent installation, commercial documents or records must show that outcome.

Create a shipment file linking the import declaration, factory invoice, packing list, warehouse records and destination evidence. Keep product descriptions and batch references consistent. A Chinese factory invoice helps identify the goods; add records of what happened after arrival. Agree identifiers when writing your product specification.

Claim when the evidence is ready

HMRC says to claim replenishment as soon as supporting evidence is available and not to wait until the waiver allowance is fully used. Put an evidence review into your stock and delivery routine so completed movements do not sit unclaimed.

The guidance also states a deadline within 3 years following notification of duty where notification was after 30 June 2023. Its older deadline of 30 June 2026 for duty paid between 1 January 2021 and 30 June 2023 has passed. Check the dates against the original declaration rather than treating evidence readiness as a fresh deadline.

Submit and track the balance change

The importer or an agent or representative acting for the importer can claim. An agent must be authorised by the importer. Settle who will prepare and submit the evidence pack; see who is the importer of record.

Use HMRC’s online claim service. Its acknowledgement email confirms receipt and gives a unique reference number. Approval is notified separately, and HMRC amends the state-aid balance for an approved replenishment claim. Keep the acknowledgement, decision and balance record together; check the balance change before budgeting for further waived imports.

Frequently asked questions

Is a replenishment claim a cash refund?

For a replenishment claim, HMRC amends your state-aid balance. Repayment of duty already paid is a separate claim outcome.

Does a Northern Ireland customer address prove eligibility?

An address alone does not establish the qualifying outcome. For sales through another business, HMRC asks for sale evidence and evidence that the goods will subsequently be sold in Northern Ireland.

Should I wait until my duty-waiver allowance runs out?

No. HMRC says to claim as soon as supporting evidence is available and not to wait until the waiver allowance is fully used.

Can I reclaim all waived duty on direct China imports?

Where EU duty exceeded UK duty at import, HMRC limits the claim to the difference between the applicable rates. The full-amount rule applies to movements from Great Britain to Northern Ireland.
