Getting started

Primary Authority for importing businesses

Yes, a Primary Authority partnership can help an importer obtain consistent Trading Standards advice across sales locations. Protection depends on following advice covering the issue, and urgent enforcement exceptions apply. Ask about territorial scope before joining. Factory evidence can be organised with Cambridge China Bridge.

Decide whether a partnership fits your business

Any business can participate, including a start-up. A direct partnership is your own relationship with a local authority; a co-ordinated partnership provides access through a trade association or other group. However, OPSS will not nominate partnerships with the tobacco industry or those seeking to further its interests.

Consider a direct partnership if different sales locations repeatedly raise the same questions about your products, labels or compliance controls. For a co-ordinated arrangement, ask whether its advice actually covers your product range and operating model. Compare the work involved with the recurring uncertainty you want to resolve.

Check the regulatory and territorial scope

Agree which Trading Standards issues you want covered. Your partnership need not cover every regulatory aspect of the business, and additional primary authorities can address gaps. You can choose a partner for relevant expertise rather than proximity to your headquarters.

Do not assume identical coverage throughout the UK: the scheme's scope differs according to reserved and devolved matters. Businesses seeking coverage for devolved matters in both England and Wales need partners in both nations. Ask the prospective authority to confirm coverage for your products and every nation where you sell.

Turn factory evidence into usable advice

Assured advice means that, provided you follow it, you should be protected against enforcement based on another enforcing authority's conflicting view. Protection concerns the regulatory issues the advice covers. Ask for a clear record of the products, processes and circumstances addressed, and what changes should trigger a review.

Prepare samples, specifications, label artwork, test reports and a description of your sales channels. Use the product compliance file guide to organise the pack and check whether reports cover your order. Cambridge China Bridge's staff in China can help gather factory records and communicate the agreed specification.

Understand what happens during enforcement

An enforcing authority normally has to notify your primary authority before taking enforcement action. Your primary authority can block action that conflicts with advice you have followed. Limited notification exemptions include urgent action. Treat protection as conditional on the relevant advice and your implementation, rather than as immunity from enforcement.

An inspection plan can guide how local authorities inspect your business; it requires approval by the Secretary of State. Ask whether a plan would help with repeated checks. If an officer contacts you, send the request and relevant implementation records to your primary authority. For handling the documents requested, see responding to a Trading Standards evidence request.

Agree the work before applying

Agree the products and issues to address, contacts, communication arrangements and costs. A primary authority may recover its costs but cannot make a profit from the partnership. Ask how advice reviews, factory changes and responses to enforcement enquiries will be handled and charged.

The authority starts the application through the Primary Authority Register; you complete your part, then OPSS checks it and arranges nomination by the Secretary of State. Wait for confirmation before treating the partnership as established. Keep an internal record of the advice, who implements it and how you check that each sales location follows it.

Frequently asked questions

Can a small importer join Primary Authority?

Yes. Any business can participate, including a start-up. Consider a direct partnership for tailored advice or a co-ordinated partnership through a relevant group. Tobacco-related nomination restrictions apply.

Must my primary authority be my local council?

No. You can choose a partner for its relevant expertise, an existing working relationship or proximity. Ask whether it can cover your products and sales territories.

Does assured advice stop Trading Standards action?

Your primary authority can block action conflicting with advice you have followed for the issues covered. Protection is conditional, and limited notification exemptions include urgent action.

Will the same advice cover every UK sales location?

Confirm the issue and territorial scope with your partner. Coverage differs across UK nations; devolved matters in England and Wales can require partnerships in both nations.
