Can customers claim after a warranty expires?
Yes, a UK consumer may still have a claim after an imported product's warranty expires. The question is whether it met statutory quality requirements, including reasonable durability, and whether the claim is within the applicable court deadline. Business purchases need separate assessment. Cambridge China Bridge helps buyers organise factory evidence.

Establish which purchase the complaint concerns
If you import goods for resale, distinguish your customer's purchase from your own supplier purchase. Ask a legal adviser to confirm which consumer or business sale rules apply to each transaction and how your supplier contract affects your claim. Our guide to faulty deliveries and claims explains that supplier relationship.
For a consumer claim, expiry of a warranty does not by itself end the right to a repair or replacement. Assess the alleged defect rather than closing the complaint with an 'out of warranty' reply. For your supplier claim, review the agreed terms using warranty administration with a UK sourcing seller. For software-related computer or file damage, see our UK seller software damage claims guide.
Assess reasonable durability
Durability is an aspect of satisfactory quality. The consumer standard considers what a reasonable person would regard as satisfactory, taking account of the description, price and relevant circumstances. A warranty's expiry date does not answer whether the product failed prematurely.
Compare the failed component with the intended use, instructions, maintenance history and description given at sale. Ask whether the evidence points to inadequate materials or construction, ordinary wear, accidental damage or unsuitable use. Record the reasons for your conclusion. Before ordering, use durability testing for imported products to plan relevant checks.
Separate court deadlines from product lifespan
The usual consumer contract claim periods differ across UK jurisdictions. They are deadlines for pursuing a claim, not promises that every product must last that long. A fault arising within the period does not automatically establish a breach of statutory rights.
For England, Wales and Northern Ireland, the ordinary contract period runs from breach, rather than warranty expiry. For a particular complaint, ask a solicitor to confirm the applicable jurisdiction, starting date and any exceptions, especially in Scotland. Give them the purchase, delivery and failure dates rather than calculating from the warranty certificate.
| Jurisdiction | Usual period | What it does not establish |
|---|---|---|
| England and Wales | 6 years | A guaranteed product lifespan |
| Northern Ireland | 6 years | Automatic entitlement for every later fault |
| Scotland | 5 years | A warranty lasting for that period |
Build a file that explains the failure
For a consumer repair or replacement request after 6 months, you can ask for evidence that the item was faulty when bought. A later breakdown needs an explanation of the underlying problem, rather than just confirmation that the product no longer works.
Collect proof of purchase, the product description, batch or serial details, photographs, usage and maintenance history, and previous repair records. Where the cause is disputed, consider an independent report explaining the failed part and likely cause. Preserve the item and removed components, and agree the inspection scope and cost before commissioning work.

Respond to the customer and investigate the batch
Acknowledge the complaint and request the missing evidence. Explain whether your assessment concerns warranty cover or statutory quality rights. Record the proposed resolution and reasons. If you dispute premature failure, address the evidence rather than relying solely on the warranty date.
For your supplier investigation, assemble the approved sample, specification, inspection records and related complaints. Ask the factory to identify component or material changes and propose corrective action. Cambridge China Bridge can help collect factory records through its staff in China. Keep the customer assessment and supplier recovery file separate so each decision has its own evidence.
Frequently asked questions
Can a customer claim after the warranty expires?
Yes, a consumer may still have statutory rights. Assess whether the product failed to meet the required quality standard and whether the claim is within the applicable court period.
Must imported goods last 6 years?
No. The usual court claim period is not a guaranteed lifespan. Reasonable durability depends on the product's description, price and relevant circumstances.
What evidence can I request after 6 months?
For a consumer repair or replacement claim, you can ask for proof the item was faulty when bought. Collect purchase records, failure details and, where useful, a report explaining the underlying cause.
Do these consumer rights cover my business order?
Your business purchase needs separate assessment under its contract and applicable business sale rules. Keep your supplier claim separate from your customer's consumer complaint.
