How to establish customs origin for China imports

Establish origin from the manufacturing history and the applicable UK non-preferential rule, rather than the seller’s address or shipping route. Collect component origins and production records, and seek an HMRC ruling where the rule is unclear. Factory evidence can be gathered by Cambridge China Bridge.

Separate origin from the buying and shipping route

Customs origin concerns where goods were produced or manufactured. It is not simply where you bought them or where the shipment started. Where preferential rules do not apply, use UK non-preferential origin rules.

Create separate entries in your buying file for the seller, manufacturing sites, component origins and dispatch location. For the paperwork question, see certificates of origin. This guide focuses on the manufacturing evidence behind the origin conclusion.

Start with the finished product and its applicable rule

UK non-preferential product-specific rules are applied using the goods’ tariff classification. Confirm the finished product’s description and commodity code before selecting the rule. Our commodity code guide covers classification.

Imported components call for a manufacturing investigation, not an automatic conclusion about the finished goods. Ask your customs adviser to identify the applicable rule and explain how the documented operations meet it. Do not accept a general claim that assembly in China settles origin without seeing that analysis.

Build a manufacturing evidence file

Ask the factory for a BOM identifying materials and components, their manufacturers, claimed origins and supporting purchase records. Obtain a process map showing what happens at each site, including subcontractors. Request production orders, material issue records, machinery details and photographs linked to the actual model and batch.

Check that component records, production records and shipment identifiers refer to the same goods. Flag missing origins and contradictions rather than filling gaps with the component supplier’s address. Keep a written explanation connecting each relevant operation to the applicable rule; see batch traceability.

Investigate what happened at the onward location

For goods routed through Hong Kong or another location, establish whether they were stored, repacked, labelled, assembled or further manufactured there. The shipping or buying location alone does not establish origin. Ask for receiving records, work orders, dispatch records and transport documents for the onward movement.

Separate handling records from manufacturing records. If the supplier claims that onward processing changed origin, ask your customs adviser to assess that exact operation against the applicable UK non-preferential rule. Keep the earlier production history in the file so the assessment does not start at the final warehouse.

Seek a ruling before relying on a disputed conclusion

Consider an Advance Origin Ruling where the rule is difficult to interpret or the manufacturing arrangements make its application uncertain. This is the route for imports into or exports from Great Britain; Northern Ireland uses a Binding Origin Information decision. Apply for an actual transaction before all customs procedures are completed, because decisions cannot be retrospective.

Prepare the manufacturing file and your proposed origin conclusion before using HMRC’s application form. Explain which rule you believe is met and why. Keep the ruling with the shipment evidence: if asked, you must prove that the declared goods and their origin-relevant production circumstances match those detailed in the ruling.

Frequently asked questions

Are goods shipped from China always Chinese origin?

Do not assume so. Origin concerns production or manufacture, rather than the buying or shipping location. Review the component origins, manufacturing history and applicable UK rule.

Do imported components prevent Chinese origin?

Do not decide from component origins alone. Ask your customs adviser to apply the relevant UK non-preferential rule to the finished product and its documented manufacturing process.

Does routing goods through Hong Kong change origin?

The route alone does not establish origin. Document any handling or manufacturing there, and assess a claimed change against the applicable UK non-preferential rule.

When should I apply for an origin ruling?

Consider applying when the rule or manufacturing arrangements make origin uncertain. Apply before all customs procedures are completed. Great Britain uses Advance Origin Rulings; Northern Ireland uses Binding Origin Information.
