Poppy seed duty and import controls

Read from the UK Trade Tariff on 1 October 2026, poppy seeds within heading 1207 carried 0% duty from China, with no anti-dumping or countervailing duty and no suspension listed. The heading covers other oil seeds and oleaginous fruits, whether or not broken. The supplied facts contain only the poppy-seed lines shown here.

Both poppy-seed lines carry an import control of organic products. Organic food imported from China into Great Britain needs a valid Certificate of Inspection, issued by the exporter's control body. Have your customs broker check the organic paperwork before shipment. Food imports must be safe and legal; seeds for eating must meet applicable aflatoxin and pesticide limits.

Separate seeds for sowing from seeds for food or other use when confirming the commodity code. For seeds for sowing, confirm applicable plant health and seed marketing rules with the relevant authority. Check with HMRC or your customs broker whether food-use seeds are zero-rated for VAT and whether seeds packaged and held out as bird food or pet food are standard-rated. See the duty and VAT guide and the wider sesame and pumpkin seed guide.

Specify colour, cleaning and bakery use

State whether the order is for bakery ingredients or sowing. For food use, agree blue or white seed, whole or ground form, colour consistency, flavour, purity, moisture and acceptable foreign material against an approved sample. Record the growing origin separately from the Chinese supplier's address, and describe any washing, drying or heat treatment.

Ask how the supplier controls opium alkaloids and request batch-specific testing as a purchasing check. Washing, soaking, grinding and heat treatment can substantially reduce alkaloid levels. Agree a laboratory testing plan for alkaloids, aflatoxins, pesticide residues and Salmonella before approving the lot; arrange testing support where needed.

Worked duty example

Illustrative example, not a quote: Illustrative order: 500 kg of cleaned poppy seeds for a bakery ingredient wholesaler under 1207 91 90 00, invoiced at £2,500 free on board, with £900 of freight and insurance to the UK. The customs value is £3,400. Duty at 0% is £0. Import VAT at 20% is charged on the customs value plus duty, £3,400, so it is £680. With no duty, the only import tax is the VAT, which a VAT-registered importer can usually reclaim. The import duty and VAT guide explains each step. This assumes the goods are standard-rated for VAT. Most food for human consumption is zero-rated, and animal feed can be too, in which case no import VAT is due, so check the rate for your product in HMRC's VAT Notice 701/14.

Inspection checklist

Identity: compare colour, seed form and flavour with the approved sample; check for substituted seeds, stalk fragments, stones and excess dust.

Condition: check moisture against the contract, inspect bag liners and seals, and reject rancid odour, visible mould or insect activity.

Reports: match the sampled lot to the delivered bag codes and laboratory reports; check that the reports cover the agreed tests and the supplied processing state.

Documents: match the invoice, packing list, intended use and batch identity; for organic food, check the Certificate of Inspection with your broker.

What goes wrong

A clean-looking sample can conceal a poorly controlled bulk lot. Foreign material, uneven colour and excess dust affect bakery appearance, while damp packing can cause mould or rancidity. A report for a different batch gives no useful assurance about the bags delivered.

A supplier may describe washing without recording how the seeds were dried afterwards. Ask for the processing record and inspect the finished lot. Keep food-use and sowing specifications separate, and settle organic documentation before goods leave China.
