Bayberry classification and duty

Read from the UK Trade Tariff on 29 September 2026, heading 0810 covers other fresh fruit. The residual line 0810 90 75 90 carries 8% duty for goods from China and is the candidate classification for fresh Chinese bayberries. The supplied facts list no anti-dumping or countervailing duty and no suspension for that line. The table shows buying formats within the same tariff line.

The tariff attaches an organic import control to this line. Confirm inspection certificate requirements for organic consignments with your customs broker; the exporter's control body issues the certificate in the country of export. Separately, ask the plant-health authority to confirm the category for fresh bayberry fruit from China. Medium-risk B goods require a phytosanitary certificate but do not require plant-health pre-notification. Do not infer plant-health clearance from the tariff's organic control alone.

Give your customs broker the fruit's botanical identity, photographs and confirmation that it is fresh when checking the commodity code. Frozen, dried and preserved products need separate classification checks. See the wider fresh-fruit guide for other goods within this heading.

Specify ripeness, fruit condition and packing

Specify cultivar, growing area, harvest maturity, colour, size grading and acceptable firmness. Agree rejection criteria for leaking, crushed, mouldy or fermenting fruit, insects and foreign matter. Use photographs and a representative sample to define acceptance rather than relying on a description such as 'large bayberries'.

Agree punnet depth, cushioning, ventilation, carton strength, cooling arrangements and temperature records through delivery. Ask the packer to demonstrate how its packaging protects the fruit's textured surface against rubbing and compression. Request lot-linked pesticide testing against applicable UK limits and retain orchard, harvest and packing records.

Fresh fruit must meet quality and labelling requirements throughout production and marketing. Check proposed labels before printing, including the product identity, Chinese origin, packer details and declared contents. Keep these checks tied to the actual lot and intended sales format.

Worked duty example

Illustrative example, not a quote: 100 kg of fresh Chinese bayberries; illustrative order and values under 0810 90 75 90, invoiced at £2,500 free on board, with £1,800 of freight and insurance to the UK. The customs value is £4,300. Duty at 8% is £344. Import VAT at 20% is charged on the customs value plus duty, £4,644, so it is £928.80. Import taxes total £1,272.80; a VAT-registered importer can usually reclaim the VAT, so the lasting cost is the £344 of duty. The import duty and VAT guide explains each step. This assumes the goods are standard-rated for VAT. Most food for human consumption is zero-rated, and animal feed can be too, in which case no import VAT is due, so check the rate for your product in HMRC's VAT Notice 701/14.

Inspection checklist

Fruit: compare colour, size and firmness with the agreed specification; open packs to check hidden crushed fruit, mould, insects and leaking juice.

Cold chain: review dispatch and journey temperature records against the agreed conditions; measure fruit temperature on arrival and photograph condensation or wet cartons.

Packing: check punnet compression, ventilation, cushioning and carton damage; verify that the declared contents match the packs.

Records: match carton lot marks to harvest, packing and test records; check organic inspection paperwork where applicable and confirm plant-health arrangements before dispatch.

What goes wrong

Bayberries can arrive looking acceptable on top while fruit beneath is crushed or leaking. Overripe fruit, compression and interrupted cooling can leave a consignment unsuitable for the buyer's intended sale. Inspect opened packs on arrival and record condition before moving the stock.

A sample does not establish the condition of the shipped lot. Agree sampling, rejection evidence and responsibility for damaged arrivals before ordering. Use the quality inspection guide to prepare a brief that covers fruit condition, packing and lot records.
