Getting started

Can a gift recipient return faulty goods?

A recipient can contact the UK seller, but statutory returns rights normally belong to the purchaser. Ask the purchaser to make the claim or arrange permission to handle it. A gift receipt helps identify the sale; a transferable guarantee may provide a separate route. Discuss gift complaint arrangements with Cambridge China Bridge.

Identify who bought the gift

Start with the order confirmation: who contracted with the UK seller, and was the purchase personal or for business purposes? The default returns obligation is to the purchaser. Receiving a China-made product as a gift does not, by itself, make the recipient the purchaser.

Consumer status concerns an individual buying wholly or mainly outside their business or profession. If your company bought gifts for staff or customers, start with its supply agreement rather than assuming consumer remedies apply. Check the UK seller business supply terms guide.

Use the gift receipt to trace the sale

Ask for the gift receipt, order reference and seller's gift returns policy. Check whether the seller offers the recipient an exchange, credit or another remedy. Treat the receipt as a way to identify the transaction and check the seller's promise; do not assume it automatically transfers every statutory right.

A seller can ask for proof of purchase, which can include a sales receipt or other evidence such as a bank statement. Ask the purchaser to supply the relevant transaction record if the gift receipt is missing. For the wider evidence question, see faulty returns without a receipt or packaging.

Agree permission to handle the complaint

The simplest practical route is for the purchaser to open the complaint and name the recipient as the contact. Ask the seller what permission it needs before discussing the order or arranging a return. Keep the purchaser involved if the seller will only process the claim with them.

Suggested wording: ‘I purchased this item as a gift. Please discuss the fault and arrange collection or replacement with the recipient named below. Refer any proposed settlement or refund to me for approval.’ Record the order reference, contact details and agreed scope. Handling correspondence and transferring legal rights are separate questions.

Check the guarantee separately

A free consumer guarantee creates an obligation for the guarantor under its statement and associated advertising. Check who provides it, whether gift recipients or subsequent owners are covered, and what evidence or transfer procedure is requested. If the terms cover the recipient, use that guarantee route without confusing it with the purchaser's statutory claim.

A guarantee does not remove the consumer's statutory rights. The Competition and Markets Authority also warns that making guarantees non-transferable is likely to be unfair. If transfer is refused, ask for the exact term and seek advice before accepting the refusal. See what a free consumer guarantee must say.

Prepare a complaint the seller can resolve

Send the seller a short account of the fault, photographs, the product identifier, purchase and delivery dates, and the requested outcome. State whether the recipient is acting for the purchaser or claiming under a guarantee. Ask who will arrange collection, where any replacement should go and how a proposed refund will be handled.

For business gift orders, agree the recipient contact process before distribution. Keep the purchaser, seller and guarantee provider clearly identified in the records. Ask Cambridge China Bridge to discuss the factory records and support information needed for your gift programme.

Frequently asked questions

Can I return a faulty gift to the UK seller?

Contact the seller, but the default returns obligation is to the purchaser. Ask them to open the claim and authorise you as the contact, or check whether a guarantee covers you.

Does a gift receipt transfer my legal rights?

Do not assume it transfers every right. Use it to trace the sale and check the seller's gift returns promise. Keep the purchaser available if the seller requires their involvement.

Can I complain without telling the gift giver?

Ask whether the seller's gift returns policy or the guarantee covers you directly. If neither provides a route, involving the purchaser is the practical next step.

Are guarantees transferable when goods are gifts?

Check the guarantee and any transfer procedure. The Competition and Markets Authority warns that making guarantees non-transferable is likely to be unfair. Ask for the exact term if refused.
