Will the factory refund my sample fee?

Treat the promise as a conditional credit until the factory confirms whether it means cash back or a deduction from your production bill. Agree eligible products, qualifying quantities, expiry, the refundable amount and settlement currency before paying for samples. Define what the promise actually covers

Ask whether “refund” means money returned to your account or a credit against a production order. List which paid charges qualify: the sample itself, revisions, courier delivery, tooling or testing. Record exclusions and reference the sample quotation, invoice and payment. Do this before paying, while the promise can still influence your supplier choice.

Pin down qualifying quantities and products

Ask for the qualifying quantity or order value in writing. Clarify whether it applies per model, colour or size, or across the whole order. Check whether mixed products, trial orders and split deliveries qualify, and whether separate orders can be combined. A factory’s production MOQ and its sample-credit threshold may differ.

Identify eligible products by model and specification. Ask whether a revised design or a different product cancels the credit. Define “first order” as well: your first purchase from the factory, or your first production purchase of the sampled product. Carry the agreed terms into your production purchase order.

Agree expiry and any partial credit

Request a calendar expiry date and the event that must happen before it: order acceptance, deposit receipt or another agreed milestone. Ask what happens if sample revisions or factory delays push that event beyond the deadline. Obtain an extension in writing before relying on it.

Confirm whether the entire eligible fee is credited or only an agreed part. If the order falls below the threshold, ask whether a smaller credit is available. Record any cap, how the deduction is calculated, whether an unused balance carries forward and what happens if you cancel or reduce the order.

Fix the settlement currency

State the credit amount and currency explicitly. If the sample payment and production invoice use different currencies, agree the conversion source, conversion date and who bears bank charges. Avoid wording that lets the factory choose the exchange rate when it issues the invoice.

Clarify whether the credit reduces the deposit or the final balance. For a cash refund, agree the payment date, destination account and responsibility for transfer charges. Use our supplier quotation currency guide for the wider deposit and balance arrangements.

Make the production invoice reconcile

Ask for a separate line labelled “Sample fee credit”, referencing the sample invoice and showing the agreed deduction in the production invoice currency. Keep goods, freight and other charges visible, followed by the credit, revised total, deposit already paid and remaining balance. Check the calculation before payment. If a separate credit note is used, have the invoice reference it and reconcile the documents.

Keep the commercial deduction separate from the customs valuation decision. HMRC allows a discount to be excluded only when it relates to the goods being valued and there is a valid contractual entitlement at valuation; discounts relating to previous imports cannot be claimed in full against the current import. Give your customs agent the sample invoice, credit terms and production invoice so they can assess the treatment.
