Getting started

Faulty goods: how do I check the court deadline?

Ask a solicitor to confirm the applicable UK jurisdiction, claim type, starting date and deadline. Supply the contract, delivery records and fault history; do not calculate from warranty expiry alone. Get advice promptly if time may be short. Cambridge China Bridge can help organise factory evidence.

Identify the purchase and the applicable jurisdiction

Start with the seller named on your contract and invoice. Give your solicitor the buyer’s and seller’s addresses, delivery location, purchase purpose, and any governing-law or court clause. Ask which UK jurisdiction and deadline rules apply to this transaction.

Keep your business purchase separate from any consumer complaint by your customer. Each needs its own assessment. Scotland and Northern Ireland have different court claim processes from England and Wales. For the wider complaint route, see goods disputes with a UK seller.

Use the general periods as a warning, not a calculation

In England and Wales, the ordinary limit for an action founded on simple contract is six years from when the cause of action accrued. Ask a solicitor to confirm the applicable consumer contract period in Northern Ireland or Scotland. The England and Wales figure does not establish your individual deadline.

For Scotland, the legislation generally refers to when the obligation became enforceable, subject to its specific provisions. Ask a solicitor to identify the relevant obligation, starting date and exceptions. For a business order, request a calculation under your actual contract and claim rather than applying the consumer summary.

Prepare a dated chronology with supporting records

Record when the contract was agreed, payment was made, goods were delivered and the fault first appeared. Add when you discovered the likely cause, notified the seller, requested a remedy and received each reply. Include repairs, replacements and any written admission or proposed settlement. Attach the supporting document to each entry.

Ask your solicitor which event establishes the alleged breach and whether any later event affects the deadline. Mark uncertain dates clearly. Do not substitute the date you complained for the delivery or breach date. Keep evidence about the fault alongside the chronology, using our faulty deliveries and claims guide.

Keep warranty cover and court deadlines separate

A warranty expiry date does not by itself answer whether a consumer claim remains available. Equally, a court claim period is not a guaranteed product lifespan or proof that a later failure breaches the seller’s obligations. Our claims after warranty expiry guide explains that distinction and the durability evidence.

For your business purchase, give the adviser the warranty, supply terms and any complaint-notification wording. Ask them to distinguish contractual warranty cover, notification conditions and the applicable court deadline. Record these separately so the warranty certificate does not become your only reminder.

Obtain advice before waiting for another reply

If the purchase is old or a starting date is uncertain, contact a solicitor promptly. Ask for written confirmation of the deadline, its assumptions, and the action needed to protect the claim. Ask specifically whether continuing complaints, negotiations or repairs affects that calculation. Do not assume another seller reply makes it safe to wait.

Tell the solicitor immediately if the earliest possible deadline may be close. Send the chronology and available documents without waiting for a complete technical report. Ask them to confirm who will take the required action and by when. Cambridge China Bridge’s staff in China can help gather factory records while your solicitor assesses the deadline.

Frequently asked questions

Does the court deadline start when the warranty ends?

Do not calculate from warranty expiry. For an ordinary contract claim in England or Wales, the period runs from breach. Ask a solicitor to confirm the starting date and any exceptions, including the applicable rules if your claim is in Northern Ireland.

Does complaining to the seller protect my deadline?

Do not assume it does. Give your solicitor the complaint and reply dates, and ask what action is needed to protect the claim before the applicable deadline.

Which dates should I give a solicitor?

Supply the contract, payment, delivery, fault discovery, complaint, repair and replacement dates, with supporting records. Include admissions and settlement correspondence.

Can I use the consumer deadline for a business order?

Ask for a separate assessment of your business contract and claim. Keep your supplier purchase separate from your customer’s consumer purchase, even where both concern the same faulty batch.
