Academy trust China equipment: when DfE must approve
An English academy trust must obtain DfE approval before agreeing or entering into a novel, contentious or repercussive equipment transaction. Approval is required regardless of value; assess the arrangement, not simply its Chinese origin. Cambridge China Bridge can help gather factory information for the trust’s assessment.

Assess the arrangement before choosing the factory
Ask what makes this purchase unusual for your trust: unfamiliar commercial terms, an experimental use, public criticism or implications for other public bodies. Record the concerns against the novel, contentious and repercussive tests. For the wider purchasing file, use our school and charity approval pack guide.
Apply the approval tests to your proposal
Novel means the trust lacks experience of the transaction or it falls outside normal business. Contentious means it may attract criticism from Parliament, the public or media. Repercussive means it may establish a precedent with wider financial implications. For example, scrutinise an unfamiliar equipment revenue-sharing arrangement or a controversial school surveillance proposal; these are screening prompts, not automatic classifications.
Keep the order uncommitted while approval is pending
DfE approval must precede agreement and the transaction itself. As a purchasing control, hold back signed orders, deposits, tooling instructions and production authorisations while the approval question is unresolved. Ask the supplier to keep quotations and draft specifications separate from order acceptance. Do not let an agent confirm the purchase on the trust’s behalf.
Prepare a case that explains the equipment and the risk
Prepare a business case explaining the proposed arrangement, its possible approval triggers, alternatives, benefits and risks. Attach comparable quotations, a landed-cost calculation, installation needs, support arrangements and the consequences of cancellation or failure. Ask for factory identity, model details and clear warranty responsibilities. Use our supplier risk register guide to organise outstanding questions.

Resolve doubt and retain the decision
If doubt remains about whether the transaction is novel, contentious or repercussive, refer it to DfE for determination. For the sourcing file, retain the proposal assessed, correspondence and documented approval together. Match the eventual order to that proposal and flag changes in equipment, payment terms or liabilities for fresh review. Our board risk acceptance guide helps organise the internal decision record.
Frequently asked questions
Does every China equipment order need DfE approval?
Assess the transaction against the Handbook’s tests. Chinese origin alone does not explain whether an arrangement is novel, contentious or repercussive. Record what is unusual about the proposal.
Can a low-value unusual purchase avoid approval?
No. DfE’s guidance says novel, contentious and repercussive transactions require approval regardless of value.
Can trustees approve the order instead of DfE?
Internal approval cannot replace the DfE approval required for a novel, contentious or repercussive transaction. Keep supplier commitment on hold.
Can we pay the factory deposit while DfE decides?
Keep the deposit on hold. Required approval must be obtained before the transaction is agreed and before it occurs, rather than before shipment alone.
