UK import duty and VAT on China auction purchases

Ask your courier or broker for separate customs duty and import VAT calculations using the auction terms, itemised invoices and payment records. Check what the buyer’s premium pays for before claiming an exclusion, and reconcile shipping and checkout VAT. Ask Cambridge China Bridge to help obtain supporting documents in China.

Confirm the purchase and destination

This guide concerns a personal auction purchase shipped from China to England, Scotland or Wales. Request a separate assessment for Northern Ireland. Tell the courier whether the purchase is solely for personal use and whether you are VAT registered. Ask it to confirm the commodity code, origin, applicable rates and whether VAT was collected at checkout.

For the wider payment and delivery questions, use our personal purchases tax guide. Here, the task is to explain the auction charges and give the declarant enough evidence to assess each amount.

Start with the hammer price and explain the premium

The hammer price is the winning bid. Request an auction statement separating that amount, the buyer’s premium, other services, shipping and any tax already charged. Customs valuation starts from the total payment for the imported goods, with the relevant adjustments. Declaring only the hammer price without explaining the other payments leaves the calculation incomplete.

Ask your customs broker to confirm whether selling commission must be included in customs value and whether genuine buying commission paid to your own representative can be excluded when separately shown. A charge called a buyer’s premium does not establish that relationship: ask whom the auctioneer represents, what the payment covers and which contractual clause requires it. Our customs value guide explains the general additions and exclusions.

Test separately invoiced services

For a bidding agent, inspection, authentication, storage or packing invoice, record the provider, customer, work performed, payment recipient and connection to the lot. Ask the broker to explain the treatment for duty and VAT separately. Do not use a separate invoice or a service label as the sole reason for excluding a payment.

Buying commission means a fee paid to an agent representing you in buying imported goods. Supply the agency agreement and correspondence showing those instructions. For a personal purchase where you are not VAT registered, specifically ask whether buying commission enters the import VAT value even if excluded for duty. Do not copy a business reverse-charge explanation into your personal calculation.

Reconcile shipping and the VAT calculation

Ask your customs broker to confirm how transport, insurance, loading and handling connected with delivery to the UK border should be treated in customs value, and whether separately identified delivery charges beyond the border can be excluded. Request a shipping breakdown showing collection, packing, international freight, insurance, clearance and onward delivery, and mark amounts already included in another invoice.

Import VAT valuation starts from customs value. Ask the broker to show the subsequent adjustments, including its treatment of duty, commission and delivery to the documented UK destination. Request the destination document and check that each cost appears only where appropriate. For an art lot, use our original artwork tax guide before assuming standard VAT treatment.

Send a linked evidence pack and check the bill

Send the lot listing and photographs, auction terms, seller and auctioneer identities, itemised auction statement, service agreements, invoices, payment receipts, shipping breakdown and checkout VAT receipt. Connect them using the lot reference and shipment reference. Include a plain description of materials, use, condition and any claimed artwork status. Our multiple-invoice evidence guide covers the wider document reconciliation.

Ask for written workings showing the customs value, duty calculation, import VAT value, VAT calculation and courier fees separately, with reasons for including or excluding disputed charges. If someone proposes special auction treatment, ask which customs procedure and supporting documents justify it for this shipment. Compare the final bill with those workings and request a documented correction where they differ.

Frequently asked questions

Do I pay UK import tax only on the hammer price?

Do not assume so. Give the broker the hammer price, premium, service invoices and shipping breakdown, and request separate duty and VAT workings.

Can I exclude the buyer’s premium from customs value?

Its name is insufficient. Establish whom the auctioneer represents. Ask your customs broker to confirm whether genuine buying commission can be excluded when separately shown and whether selling commission must be included.

Does a separate service invoice avoid import VAT?

A separate invoice alone does not establish an exclusion. Ask the broker to assess the actual service and your personal buying circumstances, including your VAT registration status.

What documents should I send my courier?

Send the lot listing, auction terms, itemised invoices, payment receipts, agency agreement where relevant, shipping breakdown and checkout VAT receipt, linked to the shipment.
